CHANGE NOTICE FOR MANUAL 01-10, CITIZEN/ALIEN REQUIREMENTS

I. Background
The Deficit Reduction Act of 2005 (P.L. 109-171) mandated that all Medicaid applicants and recipients claiming to be citizens of the United States must provide documentation of citizenship. The Children’s Health Insurance Program Reauthorization Act of 2009 (CHIPRA or Public Law 111-3) modifies the Deficit Reduction Act of 2005 to extend those requirements to North Carolina Health Choice applicants and recipients. Effective January 1, 2010, the requirement to provide documentation of US citizenship and identity applies to applicants of North Carolina Health Choice (NCHC).
Effective January 11, 2010, a Social Security Administration (SSA) Citizenship match is available through EIS for NCHC and Medicaid applicants. A returned accurate match verifies both citizenship and identity for any NCHC or Medicaid applicant. The SSA data match is completed only for individuals who state they are US citizens.
II. Content of Change
A. MA-2504, Citizen/Alien Requirements, has been revised:
1. To extend the citizenship and identity verification requirement to NCHC applicants/recipients.
2. MA-2504 III.C. Chart 1 is revised to incorporate new C/I Code 11, for those individuals whose allegation of citizenship is consistent with SSA data. C/I Code 11 is automatically entered by EIS.
3. MA-2504 III.C. Chart 1 is revised to incorporate new C/I Code 12, for those individuals whose allegation of citizenship is consistent with SSA data. C/I Code 12 is manually entered by IMC.
4. MA-2504 III.B is revised to include a 90 day period for those applicants/recipients with an inconsistent C/I SSA match, to provide documentation of citizenship/identity.
5. MA-2504 III.B is revised to incorporate new C/I Code 97 for those individuals with an inconsistent C/I SSA match, who are allowed 90 days to provide verification of citizenship/identity.
6. MA-2504 III.B is revised to incorporate new C/I Code 98 for those individuals who were receiving assistance or applied for NCHC prior to 1/1/10 who must provide C/I verification by the next redetermination.
7. MA-2504 III.B is revised to eliminate the use of special review code “Z” at redetermination.
8. MA-2504 XIV.B.5 is updated with a new mailing address for the US Citizenship and Immigration Services.
B. MA-2505, Citizenship/Identity SSA Data Match has been issued:
1. As a new section to outline procedures to request a Social Security Administration (SSA) Citizenship/Identity (C/I) match through EIS.
2. To include the addition of a new field on the 8124 screen. The new citizenship indicator field (CTZ field) on the 8124 screen is used to answer the individual’s allegation of citizenship.
3. To include procedures to be followed for new C/I code 97 for those individuals with an inconsistent C/I SSA match.
4. To include a 90 day period for those applicants with an inconsistent C/I SSA match, to provide documentation of citizenship/identity.
5. Beginning January 11, 2010, a NCXPTR report titled DHRWDB CITIZENSHIP APP RESPONSE will be available. The report displays the response from the SSA match.
6. EIS is developing an automated citizenship response screen to replace the DHRWDB CITIZENSHIP APP RESPONSE report. Notification of availability will be issued at a later date.
7. Counties are required to redisplay applications taken January 4, 2010 – January 8, 2010, and enter a “Y” in the citizenship indicator field (CTZ) on the 8124 to submit a C/I match request to SSA for those individuals who state they are a US citizen.
C. MA-2304, Processing the Application, has been revised to include applicants given the 90 day period to provide verification of citizenship.

III. Effective date and Implementation
This change is effective January 01, 2010. Apply this policy to any applications taken on or after January 01, 2010.
