The Children’s Health Insurance Program Reauthorization Act of 2009 (CHIPRA or Public Law 111-3) modifies the Deficit Reduction Act of 2005 (P.L. 109-171) which mandated that all Medicaid applicants and recipients claiming to be citizens of the United States must provide documentation of citizenship. Under the new provisions, Tribal enrollment or membership documents issued from a federally recognized Tribe must be accepted as verification of citizenship and no further identity documents are required.
The Department of Defense Appropriations Act of 2010 (P.L. 111-118) amends the Refugee Crisis in Iraq Act of 2007 (P.L. 110-181) and the Afghan Allies Protection Act of 2009 (P.L.111-8) by making Iraqi and Afghan Special Immigrants (SIVs) eligible for resettlement assistance, federal benefits, and entitlements for the same time period as refugees. Iraqi and Afghan special immigrants will no longer be bound by the 5-year bar or limited to an 8 month period of eligibility for Medicaid or North Carolina Health Choice (NCHC).
This policy is effective March 01, 2010. Apply this policy to any applications or redeterminations taken or in process on or after March 01, 2010. This includes retroactive months, but no earlier than December 2009 for the Iraqi/Afghan Special Immigrant eligibility changes.
