The North Carolina General Assembly in Senate Bill 622, Appropriations Act, under Section 10.21(a) amended the General Statutes to require verification of state residency at application for individuals in private living arrangements. This amendment ensures that individuals do not come to North Carolina with the intent of maintaining a temporary residence for the purpose of obtaining medical assistance. In the same bill, the General Assembly stated that individuals who do not have the required documentation must make a declaration, This declaration is subject to criminal prosecution. These individuals may provide statements from specific individuals who have knowledge of their situation.
This policy is effective January 1, 2006. Apply this policy to applications taken on or after January 1, 2006, and persons moving into North Carolina on or after January 1, 2006. This policy does not apply to redeterminations.
